General Terms and Conditions
Amden Weesen Ferien und Freizeit GmbH
for booking accommodation services
These General Terms and Conditions (T&Cs) govern the legal relationships between travel participants and Amden Weesen Ferien und Freizeit GmbH, hereinafter referred to as AWFF. These T&Cs form an integral part of the contracts.
1. Scope of Application
These T&Cs apply to all services provided by AWFF for legal and natural persons. General terms and conditions of the guest that deviate from these T&Cs are only applicable if explicitly acknowledged in writing by AWFF or its booking offices. These T&Cs apply to all travel participants.
2. Services Provided by AWFF
AWFF provides the following services to guests as described in these T&Cs and other applicable contractual documents:
- Brokerage of holiday apartments/houses
- Brokerage of hotel bookings
- Sale of package arrangements
- Sale of products, services, etc.
The services (products, services, rental properties, etc.) are described in the brochure or online, in individual offers, and in the booking confirmation. AWFF does not guarantee that the functions on AWFF's or its partners' websites will be uninterrupted or that the websites or respective servers are free from viruses or harmful components. Additionally, AWFF does not guarantee the accuracy, reliability, or completeness of the information published on the websites.
3. Contract Conclusion
The contract between the guest and AWFF is only concluded upon receipt of the T&Cs from AWFF. The confirmation can be made in writing or via email. From this point onward, the rights and obligations of the contract (including the T&Cs) apply to the respective parties.
If AWFF acts as an intermediary, the contract is directly concluded between the guest and the service provider. AWFF is entitled to collect payments from the guest on behalf of the service provider. In this case, AWFF acts as a concluding agent with collection authority in accordance with OR Art. 418 ff. AWFF is obligated to forward the received payments to the contracting partner.
After completing the booking, you will receive a written confirmation with all essential details of the services you have booked. Any discrepancies from the details provided by you must be immediately communicated to AWFF or the respective booking office.
If a person books on behalf of other participants, they are responsible for their contractual obligations, particularly for payment, as well as their own obligations.
The number of persons stated in the contract must be respected at all times (otherwise, the contract may be terminated without compensation).
4. Prices and Additional Costs
The prices and additional costs listed in the contract in Swiss Francs are generally binding. AWFF reserves the right to adjust prices in case of the introduction or increase of fees, taxes, and transportation costs after contract conclusion. Price adjustments for package arrangements follow the special provisions for package tours. Price details are in Swiss Francs and include VAT unless otherwise stated. Additional costs are generally not included in rental prices. AWFF may provide relevant authorities with the names, addresses, and birth dates of guests, as well as occupancy data, upon request. If additional costs are not included in the price, they will be listed separately in the booking confirmation. Additional services can be purchased separately for an extra cost.
5. Payment Terms
If payments are not made on time, AWFF may withhold services, terminate the contract, and claim cancellation costs as outlined in section 7. The payment terms stated in the booking confirmations apply.
6. Changes and Cancellations by the Guest
Changes or cancellations of a booking must be communicated to AWFF in writing and are only valid with their written consent. The guest has the right to provide a substitute guest under the agreed conditions if they are unable to attend.
If a booking is changed or canceled by the guest, they must bear the cancellation and processing fees as outlined below. Rescheduling, such as changes to arrival and departure dates, room type, number of persons or rooms, and cancellations, can be made at any time if the service providers offer this possibility.
The cancellation conditions are outlined in the "special provisions." The date of receipt of the notification is decisive. For Saturdays, Sundays, or public holidays, the next working day applies.
Refunds for payments already made will be processed by AWFF within 30 days of cancellation/rescheduling, minus booking/rescheduling fees.
We recommend that guests take out cancellation insurance to cover the corresponding cancellation costs in case of illness, accident, or death. The processing fee and insurance premium are the guest's responsibility.
7. Late Arrival, Early Departure
The guest is responsible for their arrival. In case of late arrival due to disruptions or delays in public or private transport (including rail and air), as well as personal reasons, no refund will be provided. In case of early departure, the full amount remains due.
8. Changes by AWFF
AWFF/contract partner reserves the right to modify advertised services and prices at any time before the conclusion of the contract. After the contract is concluded, AWFF/contract partner is entitled to modify services and offer replacements in case of unforeseeable or unavoidable circumstances before or during the stay.
In cases of force majeure, natural disasters, or other reasons that hinder or endanger contract fulfillment, AWFF/contract partner is entitled to terminate the contract with a refund for unused services (any compensation claims are excluded).
Similar provisions apply for other circumstances not attributable to the contract partner, such as blocked roads, interrupted access routes, weather conditions, increased noise, power outages, environmental disasters, political unrest, strikes, or operational hours of tourist facilities.
9. Cancellation by AWFF/Booking Office
AWFF or the booking office may cancel booked services if the guest's actions or omissions provide justified cause for such cancellation.
10. Guest Liability and Complaints
The guest agrees to handle the rented accommodation and inventory with care. Guests must respect the house rules and are liable for damages caused by them or their guests. Any damages must be reported immediately. Damages identified after the return of the accommodation or service usage can also be claimed.
Should there be defects in the rented property upon arrival, occur later, or if guests have complaints, these must be immediately reported to the landlord/service provider. The landlord/service provider is obligated to provide reasonable assistance. For intermediary services, the resolution of defects lies solely with the landlord/service provider, and no claims can be made against AWFF.
11. AWFF Liability
AWFF is liable for poor service or damages only if caused by its negligence. Liability is limited to applicable laws and agreements. AWFF is not liable for:
- Guest's actions or omissions.
- Third-party actions or omissions unrelated to the provision of services.
- Events beyond AWFF's control, such as road closures, weather conditions, or environmental disasters.
- Theft or damage to personal valuables such as jewelry, cash, or electronics.
12. Data Protection
AWFF adheres to applicable data protection laws regarding all data collected or processed related to guests. For more details, refer to the privacy notice at amden-weesen.ch/datenschutz.
13. Final Provisions
Notices sent via email are considered written communication. Swiss law applies exclusively, with Amden SG as the sole legal venue for disputes.
